European funds, the lens of the Court of Auditors against dysfunctions, fraud and corruption: interview with President Guido Carlino

“The Court of Auditors – clarifies the High Magistrate – also verifies the methods of employment of the union funds entrusted to companies, through public administrations, to carry out public spending programs. In fact, art. 22 of EU Regulation 2021/241 requires Member States to provide for an effective and efficient control system and to adopt “all appropriate measures, in particular as regards the prevention, identification and rectification of fraud, cases of corruption and conflicts of interest”, to protect the financial interest of the European Union and to guarantee a use of funds in accordance with Community and national law. On this point, the Court control sections verify the correct use of funds thanks to monitoring tools capable of ascertaining the quality of the expenditure and promptly intercepting possible management dysfunctions and operational delays, before they can compromise the achievement of the expected goals. The jurisdictional sections, on the other hand, decide on the actions of damage proposed by the regional prosecutors also in the interest of the European Union, as per the consolidated jurisprudence of the Cassation (order no. 20701 of 10 September 2013). Moreover, the action can also be exercised against private individuals, and therefore companies, recipients of contributions or public funding, in the event of the use of the resources discounted by the public purposes provided for by the expenditure programs subject to financing “.

The appearance of the scams is certainly one of those under the magnifying glass. How do they expand and on what figures do they get?

“In reality, to protect the financial interests of the Union, the Court of Auditors intervenes not only in relation to fraudulent conduct or fraudulent understood in the criminal meaning, but also on episodes of bad management, the result of serious negligence and not necessarily characterized by Dolo. From the statistics published on the occasion of the inauguration of the judicial year 2025, it emerges that the prosecutors at the Court of Auditors issued, in 2024, 271 summons of summons in court, for over 277 million euros of undue delivery or bad use of national and EU public funds “.

Do PNRR projects are a multiplier effect of these illegal conduct?

«Undoubtedly, the presence of remarkable public resources also urges the interests of organized crime to derive illegal advantages. Particular attention is therefore also necessary for the territory by the regional prosecutors of the Court of Auditors, every time the ordinary judge or the Guardia di Finanza point out episodes of undue appropriation of public resources in application of the EU Regulation 2021/241, which requires the Member States to provide “the recovery of the amounts erroneously paid or used in an unpublished way” “.

What is the way to follow for optimal use of funds and to what extent synergies with other institutions and/or authorities are important?

“The optimal use of funds requires intense administration activities, with methodological approaches aimed at developing shared systems of analysis and data evaluation. The synergy between all the control and judicial institutions in charge of interrupting irregularities and inefficiencies in administrative action is also fundamental and to counteract serious deviations from the community and national objectives, cases of corruption and fraud to the detriment of the European budget. In this regard, the close cooperation of the prosecutors of the Court of Auditors both with the European Prosecutor (Eppo), and with the Olaf, the European Office for the Anti -Frords struggle, for the fight against corruptive phenomena, fraudulent and any other illegal activity that harms the financial interests of the European Union “should be detected in this regard.

What contribution can the conference of Cosenza give to the public debate and to the institutional and entrepreneurial action?

“The conference of Cosenza, expertly organized by the President of the Chamber of Commerce Klaus Algieri, contributes to enhancing themes of great importance that affect the social and economic fabric and to make people understand the serious damage for citizens, families and businesses, deriving from the illegal use of community resources, which constitutes a brake on investments and development”.

Algieri: economic legality builds trust and development

“The protection of the financial interests of the European Union is today a shared responsibility involving institutions, businesses and civil society”. This was stated by the president of the Cosenza Chamber of Commerce Klaus Algieri, who will open the two days of study tomorrow in the Bruzia city. “The conference promoted by our Chamber of Commerce – he explains – was born with the aim of offering a concrete reflection space on how to prevent abuse, waste and inefficiencies that compromise trust in European funds and the development of the territories, affecting directly on the quality of life.

The presence of speakers of excellence, starting from the president of the Court of Auditors, Guido Carlino, but also of the judge of the Constitutional Court, Angelo Buscema, confirms the scientific and institutional value of these two days “. The interventions will range from control over the use of unification resources to synergies between national and European authorities, passing through the active role of citizens, businesses and professionals in promoting correct use of funds for the benefit of the community.

The words of Algieri forcefully recall a point shared by the whole Cosentino chamber body: “Transparency is not only a duty, but a necessary condition to build trust, growth and future. Being able to translate the principles into concrete behaviors is the real challenge that awaits us », is keen to underline the president. That adds: «As a chamber of commerce, we believe that events like this can contribute concretely to the spread of the culture of economic legality, enhancing good practices, supporting the entrepreneurial fabric and promoting an open dialogue between institutions, local authorities, professionals and citizens.
