Messina, 63 year old convicted of abusive credit mediation: 12 months in prison and fine of 10 thousand euros

One year in prison and 10,000 fine, suspended sentencetogether with compensation for damages suffered by the civil party and the payment of legal costs. This is the sentence imposed by judge Mariagrazia Mandanici against Salvatore Cifalà63 year old from Messina, accused of abusive practice of the profession and fraud, both with aggravating circumstances. According to the charges formulated by prosecutor Stefania La Risa, Cifalà – defended by the lawyer Alessandro Billè -, in his capacity as administrator of Cifalà Consulting srl, based in Messina, would have exercised «illegally the profession of credit broker», activity for which requires special authorization from the State. And he would have carried it out against an academic from Bologna, the companies Di Costa spa and Simet srl.
In particular, “through artifice and deception”, he allegedly put the academic in contact “with the financial institution Esk Partners Saint Vincent ltd”, operating internationally, in order to obtain, through the company Ihncam Advisory lda, with registered office in Portugal, financing of 1,500,000 euros”would also have requested “an advance of 26,0000 from the offended party” and misled the latter, who paid the “sum without it ever being returned, procuring an unfair profit for himself or others, with related damage” for the person who then reported everything to the Financial Police, for facts relating to 2018, 2019 and up to 2022. The offended party is precisely the academic from Bologna, assisted by the lawyer Giuseppe Irrera.
